    I agree, even though its a good idea, we need to be focussed and go with what is achievable. If we get side tracked, we may not get anything accomplished.

    which cap on Nurse are they talking about. Is it the EB cap or H1B cap?


    They voted YES to include amendment to eliminate EB visa cap for Nurses (India, PHI)

    Will send the Nursing comm into raptures if it finall passes into law. Strong indications that it will make it. Of course that will have major impact on EB3 numbers, I guess

    Unfortunately, I had to deal with my so-called high society, dim-wit, shame-less, tradition-less-good-for-nothing in-laws (my wife's parents n all). They wanted me to run their family too and were becoming a kind of big emotional/medical liability and financial burden on me (although, they had ALL resources and I assume LOT of money too. After tolerating and caring for nearly a decade, I HAD to DUMP them 9-years ago (after I landed in US) as they were becoming too much for me. They will care only for their own-self (will never bother to see even if you like it or not), will never care if it will be convenient to me in high demanding professional job. They will never shy an opprtunity to brag, steal/rob credit for anything even not remotely linked to them and were simply loose-mouths.

    They could dare not to open-up again. But this 'Dumping' slowly and gradually has affected my family life. I really donot understand what tradition-less craps in the society there or here finally gain...If they are not capable of rejoicing the prosperity of their own daughter's family. I believe, it is actually not so common as any normal well thinking individual will never ever do this. I can never think even in worst of my times, if I can do any of that stuff to my two growing up daughters. Well this is first-ever I opened my heart anywhere..

    I only pray 'God bless our family (GBOF)' as you see in my IV-handle

    My DL expring in Sept. filed for 10th year extenison, I live in NY.
    NY DL have 2 dates, One in Top with RED Bold letters its called Temp Visa Date and at botton DL exprie date. I have contacted in DMV office. They said I can drive using bottom Exprie date which is exprie in 2010(mine) ,But I cant use the DL as ID if Temp VISA expire on DL.Unless I renew it with approved H1B visa date.So I have to Carry Passport ,recepit copy and Employer lettter with all time just as proof if cop caught me.

    Maybe someone that has had to go through this can respond.

    When you are working for a large(r) corporation, where all fees (including EAD/AP) are paid for by the company, who pays for the MTR?

    I was under the impression that the employer pays for the filing, attorney, etc. fees, am I wrong?

    I changed jobs from a desi company to a large corporation using AC 21.
    I had to file two MTRs. I have spent everything from my pocket for the two MTRs.

    Here is a bit of background. BEC's have been using a web site named 'America's Job Bank' (AJB) for posting job listings for cases that have not been converted to RIR. Effective 31st July AJB site is being discontinued and a new site named 'America's Job Exchange' (AJE) will become its successor. BECs have already started using this new site. Here is how to check if your job is posted or not:
    1. Go to http://www.americasjobexchange.com/seeker/jobsearch/keyword
    2. In the keywords field, enter the first few characters of your ETA case number. If your case is in PBEC and has a ETA case number such as P-xxxxx-xxxxx, then you would enter either Pxx* or xxx*. Do not enter any hyphen character and do not forget the '*' character at the end.
    3. Choose 'National' radio button and click 'Search Now' button.
    4. You will find a bunch of listings under the company name 'Team Exceed'. This is probably the company to which BEC cases have been outsourced for adjudication.
    5. Play around with different combinations of letters of your ETA case number. You may also click on 'Team Exceed' link on the results page to see a complete list of jobs posted by BECs.

    She recently announced in her campaign that she will increase the H1B visas
    She also made a statement that she will try for more benefits for permanent residents.

    She does not want to support only the people who are in the process of immigration???

    Whats up with that.

    May be she is afraid of Lou Dobbs...Recently he has been criticizing her for her Indian ties

    or may be she is pro Rich Indian Americans ... this might sound ridiculous but her voting ney is crazy

    They always comment about us stealing the middle class jobs...tell me one case where they don't prefer US citizen over immigrant.
    I have been interviewing for couple of companies ...the first question they ask is ...Are you US citizen 2nd question r u Permanent resident ..no..
    Then we are sorry.

    Companies do not prefer US citizens over Immigrants...I don't know where this misconception comes in to play...
    There was a guy in our office who used to complain about Chineese and Indians stealing jobs...Believe he is a big slacker ..he recently got fired...people like him form these programmers guilds.

    We do not work for less and we are not paid less...may be they deduct our Gc expenses but not much

    Why is there a misconception about us?

    Lets get this thought out of these bone heads

    We are not middle class job stealers...We are the building blocks of a strong middle class

    The state chapters don't seem to be very effective.
    I thought I was a member of the CA chapter but in the last few months I received no information from anybody in this chapter.
    I was semi-active, meaning I helped with phone calls, money and prints and that's as much as I could do at this point in time.
    And at some point there was a discussion about a new user group of only the people that are active and can contribute and it seems they went through with it.
    I understand that some things might be better discussed in a smaller group with the people that can dedicate more time, but there are different levels of commitment and if you're not open and accept that some want to help but can't do as much as others, you're cutting yourself short.
    When there is a big initiative or a push for funds and effort, you're not even reaching out to the bigger group; you're relying on the same small number of people and they too have limited resources and energy and will get tired.

    Maybe I’m just having a bad day but that was my experience and CA is one of the most active chapters so maybe all is well I’m an isolated case.

    Sometimes chapter leaders are unable to communicate the message to members on time or must be busy for their own reasons. We will note your feedback for future. Thanks.

    The fee we pay is very less compare to what we pay to Attorneys. And USCIS cannot drastically increase fees. And we are stuck. That is the reality.

    I think we should cut a check of same amount what we pay to attorneys.

    It is not the problem of money. If they privatize the USCIS operations, I will show how to get it done much quickly, correctly, with lot of customer interaction.

    USCIS wants you to believe what they tell you is the reality. It is not. They cover up their inefficiency with lies. There is way too much bereaucracy. Information does not trickle down from top to the bottom layers quickly, and top layer does not know what kind of operations are happening at bottom layer.

    At best, we are feeding their pension plans and cushy retirement benefits.

    H1B believe it or not is a "dual intent visa". F1 is NOT a dual intent visa. So what that means is even tho a person entered USA on H1B(which is Nonimmigrant visa) he can have a dual intent to "adjust status" and become a permanent resident.

    So I would think it would very wise to be given a PD based on when a person started working on "H"

    Coming in through H1 does'nt show your intention of becoming a permanent resident of this country. It only happens when the LC is applied. Although the entry date is an ingenious way, it will only create more issues. Now some one who comes in F1 can also ask for the same benefit when they move to H1, to take their entry date in F1 as their priority date. I believe the culprits are the labor substitution and the labor certification sales. Those are unfair. Stop labor substitutions, and if they need one, then use the 140 RD as the PD. That should solve most of the problems and people from using labor sub to jump the line.

    I emailed them not as me but as my employer( point of contact mentioned in the labor petition) and it works they send me a copy of the labor approval to my house along with a copy to my employer and one to my attroney. It really works.

    Could you please give more details of your case.
    How long was is pending?
    How long did it take for you to get the approval after your email?

    The Dept. of State's web site has the visa bulletin for SEpt 2008 as:

    EB INDIA

    And the US Consulate's web site at Mumbai has:

    EB INDIA
    ------------
    E1 Current
    E2 1 April 2003


    So, how come Consulates got the latest information? Why not post this on the DOS page too by the DOS?

    I am so sick and tired of this whole process of GC. I am starting to question myself if this entire process of wait, is worth at all? If you are illegal, you are free in this country, if you are legal they scrutiny your papers with a microscope....I am sick, totally sick. There is a limit to patience, too.:mad::mad::mad:

    Got my LC approved June 05 2006.
    Took only (!) 4 years from first application...

    DOL recevied: Dec 5, 2002.
    Got my 45 day letter in Feb 2005.
    EB3-RIR
    Filed in Philly DOL.
    3 others from the same company got theirs LC approved 2.5 years ago and 2 of them have their green card since a year ago. And Im the only one with a US masters degree. Great system...

    True. But why then does an employee want to join such company ? It is not that you are not aware of all these before you step to this country through Infy or TCS ?

    I never worked for them. But I have seen so many people suffering and they are ready to suffer to be in the US. I dont want to deviate from the thread..so lets stop this discussion about INFY.
