As per Murthy's site, we can apply for an interim EAD after 75 days of filing. Has anybody had any luck in getting Interim EAD from local USCIS after 75 days. Do they encourage 75 days period to get EAD. Pls let me know.

Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

You can get I-20 etc. But I think you will have to go to home country to get your F1 stamped. But better check with a lawyer.

Hi,
I am curently on h1b visa on 7th year.My i-140 got approved 3years back and filed i-485 in 2007 and waiting for gc.Now if i switch my job to different employer using my EAD,Can my previous employer revoke my i-140 affecting my gc processing.Does he still have control to withdraw.Can you please help on this.Thanks.
Employer can withdraw anytime. But you should be OK with AC21 provisions.

I know many friends of mine, who has done B.E and MS from diferent background (like Mechanical, Electronics etc) and were still able to get the LC approved from a software company since they were working there. There should not be any issue with it.

This may seem strange and confusing. Here is my case
I changed my employer from A to B with an intention of taking advantage of an existing approved labor with employer B. I applied for I-140 and H1B transfer at the same time in March 2007. I-140 was approved in June 2007. In July 2007, I applied for EAD and 485. Meanwhile, I got an RFE for H1b transfer and my attorney responded to this in time. I got my EAD approval in Sep 2007 and got FP done before my I-94 (thru company A) expiration in Nov 2007. I got a denial notice for my H1B on Nov 13 2007. My attorney missed the appeal date so no appeal has been filed for the H1B denial.
Here are my questions:
- Am I currently out of status since my I-94 expired in Nov 2007?
- If I am not out of status, what is the next course of action I should be taking?
- Will there be any issues when i try to renew my EAD?

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

Hi,
I am transfering my H1b to my friends company. And I have to bear all fees. As such my case is simple, no complications. I have good education credentials and 10+ years of exp. Got education evaluation also with me.
I just went thru USCIS site and it looks like to me that filing H1 transfer by myself (or by my friend) is a fair simple job.
Can anybody give me advice or have some experiece in filing H1 or transfer H1?

My wife is laid off and her company is going to cancel her H1B soon. h1 petition is getting expired on Oct,2009. now I am going to apply for COS to h4. If she wants get H1 status after one year can she use the same petition for H1 transfer?. or she has to apply a new H1?.

from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?
Its only 5-6 months left in her 6 year h1b visa .
