Hello,

Does anyone know if a H1B can be transferred from a University to a company? Has anyone gone through this process?

The present h1 position comes under university (non-profit) category. You cannot transfer your H1 to a company which falls under profitable category. You need to apply for a new H1 which falls under cap.

My H1 is expired and i am working in EAD now. I am going for vacation next week. I dont have valid I94 (as my H1 is expired, my I94 also expired), does it cause any problem when i reentry?

Does immigration give new I94 when we enter with AP? I appreciate your help.

Hi
I transferred my H1 to new employer and need to go for visa stamping.
I have a couple of qustions.

1.I belong to south india and my regional consulate is chennai.Can I go for calcutta consulat as I heard chennai consulate has delays in vsa processing.In such case,can I have to show any emergency proof?

2.My salary is 30k more than whatever is mentioned in petition.will it be a problem?

3.I recently heard that consulate officer is asking for contact agreement between employer and client.But in my case I have some addition layer B in between my employer A and client.So how can I provide letter.Do I need to show 2 letters.From my employer A to layer B and layer B to client?

Currently, I am working with software firm (not a contract work). My wife is re applying for H4 visa. she applied for h4 last year in Feb, i used to work with contracting firm then and refused under 214b(immigration intent). This time we are applying through attorney. Attorney have sent email thrice to Islamabad consulatein Pakistan stating that denial under 214(b) for H4 is not valid reason.
But no response from them.

However my wife is applying again and taking letter with her from attorney stating that reason was invliad.

I am wondering
1- Do we need to highlight the previous denial so much as she is applying on new h1B now
2- in any case, can they revoke and cancel my petition as if they do not find any valid reason to reject again.

There is no such thing as AP Renewal, it is always a fresh application. That is the reason application does not mention anything about renewal.

Hi

My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.

1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.

2 ) Are there any chances of rejection

3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.

4) Can we expect some decision from them this week as client is waiting.

5) At what time CSC updates the case. Is there any particular time they update the case online.

Hello,

I was born in Canada and moved to the U.S. when I was 8 years old. I was naturalized when I was 18 (4 years ago). I heard that when naturalized in the U.S, my Canadian citizenship was not lost (I never filed any paperwork with the Canadian government stating I wanted to give up my Canadian citizenship either). Is this true?

If so, can I apply for a Canadian passport? Should I do this? Are there any responsibilities/problems/repercussions that could occur if I do this?

Hi

I am working on H1B from Oct 2009. My employer and client has one layer between of them. For some family reason I need to visit India for 10 days. Will it cause any problem / Issue on airport (immigration counter) when I will come back to USA ?

In this case how can I prepare myself to face situation? What documents do I need to prepare to prove that even though I am working with one layer then also my employer control my salary and tax stuffs ?

(http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=138b6138f898d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=91919c7755cb9010VgnVCM10000045f3d6a1 RCRD) As of December 8, CIS has received approximately 61,500 cases against the regular (non-Master's) H-1B cap of 65,000. However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.

The article says that dates have moved forward because the people whose dates are current, have not applied for their visas

And suppose we could do the same -- if no one applies the gc even once the PD is current, there will be forward movement.... then WHAM! In one go, all could apply
