Few days back, I saw a thread for Poll for how many EB2 Cases are pending per year. Now I can't find it. Can anyone please point me to it?

Hi
I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.
Is this correct? Or is the lawyer being overly cautious?
If such a rule does exist can you please point me to the exact regulation?
Thanks!

My labor/I-140 documents show my salary to be 85K, I am yet to receive my I-140 approval from Nebraska Processing Center, filed in June 2006 under EB-2. Would it cause any problems when I file my I-485 ( priority date March 2004 ) next year if the salary for 2006 is less than 85K ? I was unemployed for two months this year unexpectedly. Thank you for your responses.

LCA:
LCA has to be for the location where you work -- Los-Angeles CA
Taxes:
You have to pay taxes where you live -- Los-Angeles CA
If your employer deducts taxes for NJ, there is nothing illegal about it.
You have to correct that from your side.
1. File a tax return for NJ and claim back all the taxes your employer deducted for NJ.
2. File a tax return for Los-Angeles, CA and pay all the taxes due for CA state.

Here's what the POTUS had to say: Today, there are hundreds of thousands of students excelling in our schools who are not American citizens. Some are the children of undocumented workers, who had nothing to do with the actions of their parents. They grew up as Americans and pledge allegiance to our flag, and yet live every day with the threat of deportation. Others come here from abroad to study in our colleges and universities. But as soon as they obtain advanced degrees, we send them back home to compete against us. It makes no sense. Now, I strongly believe...

Dear Sir/Madam,
I would really appreciate if you can help on the question below.
1) My wife changed her last name after our wedding.
2) She got it updated on new passport, I-20 and SSN.
Now, we are planning to travel to India. She has her old as well as new passport .. and the F1 visa and I-94 is still at the old passport.
My question is: Does she need to get her F1 stamped again in order to get the updated name on her new passport?
I would greatly appreciate your fast response.
Thanks,
-Ashu

Most of the members here think. GC are long pending only because of beneficiary or USCIS only.
This news is also making me to think about the reality of the issues in finding the good company for GC processing.
Let have discussion on this how to find good company for GC processing. Appreciate in advance.

I have filed for AOS for myself and my wife. She is visiting india next month and needs to return on H4.
Since I have valid h1....can she apply for h4 or is that risky?
Hard to tell not knowing these things:
1. Were you ever out of status from the last time you entered?
2. Do you have paychecks for all the months on H1?
3. Which visa center are you visiting ?
4. Was your wife ever out of status from the last time she entered US?
It's all in the history. If it's clean, its not a problem. If you are not sure, then wait for AP as it would be a safe backup.

I am an employee in a TARP company and according to the company rules, I must be given a notice (of 2 months) before being Fired/laid off. I was hired on H1-B and the company has processed my I-140 and waiting on my priority date getting Current.
My H1-B has to be extended now and the company's lawyers say they have not yet decided about their policy on H1-B extensions. It is expiring in the last week of this month and they have not filed yet nor they say they won't file.
According to the rules, can they just say that they will not be filing my H1-B extension as the company policies have changed? But I am still an employee, and this way I will not be given my notice period. Any suggestions please.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?
thanks.

Hello everyone!
My wife has filed for my immigration and AOS around a week back. I would be expecting the biometrics appointment letter to arrive by the 25th of August. Now, I got a call from India yesterday informing me about my grandmother being admitted in the hospital, almost breathing her last. The doctors have all but given up.
My question here is whether I can go to the USCIS office with the doctor's letters and all the remaining proofs to expedite my AP well before my biometrics are done? If yes, what else would I require in terms of documents? I can just barely wait getting it done, but I dont want to leave without the AP document.
P.S.: I haven't yet received any NOAs.
Thank you.

Indian-born Karan Kler is the executive director of the Coachella Valley Immigration Service and Assistance Inc., a nonprofit immigration counseling agency in Palm Springs, California. My friend Dan Kowalski forwarded me a really nice article on Karan's journey from an influential business and military family in India to heading a non-profit agency assisting immigrants in need.

To retain the PD, you would need the copy of the I140. Without that, there isn't much that can be done when you switch companies to keep your PD.
