Per old instructions everyone was sending to Nebraska, and new instructions published are for 'direct filing'.
Do I follow direct filing rule or Nebraska only rule?
I am finally ready with medicals and photos and will be sending packet tomorrow.

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. All,
Here is my situation.
- I have an approved I140 by my current employer and waiting for 485 to become current.
- I am in the 7th year of my H1 with current validity till mid 2011.
In case I lose job with the current employer, and the employer withdraws H1-B and I140, what are the options I have?
Can I transfer H1 or apply for H1-B with another employer? How much grace period I have to leave the country?
Appreciate any help from you guys.

Hi,
I am from India.I am on H4(dependent visa),with a stamped expiry date of May 7,2010 on my H4 visa and I-94.I got a J1 offer for further studies in USA.Till I get my required documents for J1 visa,I am guessing it will be beyond this date.My husband has already applied for his visa extension.
1.Now,if I plan to get stamping of J1 in Mexico after the H4 expiry date but with necessary receipts and documents (for H4 related),will I face any problems?
2.Do I need to go to India(my home country) for sure for stamping?
3.Is it better to have status change in USA itself(will delay start of the course)?
Awaiting for feedbacks.

JUST before Congress adjourned for its August recess, Democrats engaged in a flurry of legislative activity, while Republicans complained about a �do-nothing� Congress�s meager policy accomplishments. Deep partisan differences, narrow majorities and a Republican in the White House have frustrated Democratic ambitions and fueled a toxic atmosphere in both chambers of Congress. The public�s low approval ratings reflect broad discontent with the direction of the country but also displeasure with Congress for failing to reverse course on Iraq and for continuing the bitter partisan warfare.
But has this really been a do-nothing Congress? The circumstances are similar to those in 1995, when a new Republican majority in both houses took office under a Democratic president. So perhaps the best question to ask is, how is this 110th Congress doing compared with the 104th Congress, in 1995?
Both new majorities began by spending more time in session, holding more committee meetings and roll call votes, and passing more substantive measures than the Congress before them had. At the same time, in both cases, the number of bills signed into law by the president from January to August dropped.
Still, the Democratic Congress�s legislative harvest this year has been bountiful compared with that of its Republican counterpart in 1995. Back then, the Republicans� Contract With America was stymied by opposition from the Senate and the president. The new Congress has enacted a far-reaching lobbying and ethics reform bill, an increase in the minimum wage, recommendations of the 9/11 Commission, foreign investment rules and a competitiveness package, and has embedded a number of major initiatives and new priorities in continuing and supplemental spending bills. Democrats also made headway on energy, children�s health insurance, college student loans, Head Start, drug safety and a farm bill � though much of this awaits action in the Senate or in conference and faces a possible veto.
During the first seven months of 1995, Congressional oversight of the executive branch increased modestly in the Senate but not at all in the House. But this year Congress, especially the House, has intensified its oversight, following years of inattention and deference by its Republican predecessor.
Democratic promises to restore civility and regular parliamentary procedure by allowing the minority party a larger role in deliberations have foundered. The number of restrictive rules for debate has increased, and the conference process has been short-circuited on various occasions.
In the Senate, Republicans have made the filibuster, or the threat of filibuster, routine, setting a 60-vote hurdle for all contested legislative matters. This has led Harry Reid of Nevada, the majority leader, to file many more petitions for cloture than Bob Dole, his counterpart in 1995, did.
The chart below shows what the 110th Congress accomplished before it closed for its August recess, compared with its immediate predecessor and with the Republican Congress that took office in 1995.

It's not official, but it sounds like the Obama Administration is getting ready to make some news. Secretary Clinton told CBS News today: �Well, we have, as you know, many Haitian Americans. Most are here legally. Some are not documented. And the Obama administration is taking steps to make sure that people are given some temporary status so that we don�t compound the problem that we face in Haiti.� That sounds like Temporary Protected Status or Deferred Enforced Departure.

Hey folks who signed up for advocacy days: I am so proud of you! You signed up for the good of all of us. I heard some of you are not confirming your participation. This cannot be an option at this point!
After all the effort IV has put in in securing the appointments, I, V, We all are counting on you. You had the best intentions when you signed up and we appreciate that, now we need you to finish grad school without being a drop out.
Many hundreds of hours have gone into organizing this event and not having folks at a meeting that has been confirmed is bad PR for IV and disappointing, sad and frustrating for the people who have been working tirelessly. Can't have it, can't tolerate it. You guys must follow through on your commitment!!!!
PM me if you have some pressing issue and maybe we can muster up some help to pull you through..

Immigration lawmakers try to pick winners and losers. The problem is that just like a broken analog clock with its hands frozen in place, the timing is mostly wrong. This brings me to one of my pet peeves. It bothers me that the immigration laws and agency regulations favor some fields of study and disfavor others. Why for example are students in the STEM subjects(Science, Technology, Engineering and Math) given 27 months of "optional practical training" -- a euphemism for work permission --- while liberal arts students get only 12 months? I am working on L1 from Company A.
I have applied for L1 to H1 status for year 2008 from comany B. H1 got approved without COS. As COS not done, I continued working on L1 with company A. Now my L1 is getting expired on Aug 2010 and my L1 company want to extend L1.
While applying for my L1 extention, my H1 applival cause any problem.
Please help me to get more info on this. Please let me know if you need more details on this.

Is premium processing available for EAD?
It seems USCIS published rule in federal register at one time. http://a257.g.akamaitech.net/7/257/2422/01jan20061800/edocket.access.gpo.gov/2006/pdf/06-4754.pdf
I checked current EAD form and dont see any reference to premium processing being available

As long as she was ni status should be fine, not sure if they look into tax returns and u guys didnt show much ....
