To Experts and Attorneys,

I have a question regarding AC21 portibility. I got my EAD in Oct 12th 2007. In the labor(used a pre-approved labor), the base pay mentioned is 48K and I was getting paid 55K from my current employer(A) who filed my green card.
I am getting another job in company (B) in the same field. The salary offer is better but is very high than mentioned in my labor. The new salary is around 85K.

1) Will the high salary will cause any issue with green card process if I take AC21 and use my EAD. Anyone had this kind of experience with the salary difference.

2) How do I know my new job is in the same or similar category as defined by USCIS.

3) Is AC21 is safe to take.

Question: If the I-140 is pending and not yet approved and I filed for I-485, will I receive Fingerprint Notice or I-140 approval is needed before Fingerprinting?

Hi,

Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:

Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.

My questions are this:

1.) When I enter US back in with my AP in Jul 11, will that impact my H1B extension in any way.

2.) Without any EAD will I be Jeapordizing my AOS in any way.

I will be continuing to work with the same employer who is the sponsor of my current
I485.

Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

Hi

I have filed 140 /485 concurrent on Aug 3rd and haven't received any receipt. Have opened SR , Sent FAX ..but no updates.

As per the nrew rule implemented on July 16th , All the previously approved labor will expire on Jan 12 2008.

If for any reason we don;t receive receipt , what happens to labor.. Are we back to square one ..

If anybody in simiar situation... Please reply.

I have two different I-94's, since during one of the extension i was in india.

i am on h4 visa

In the expired visa the I-94 is until 04/10/2006 ----------34786387997(I-94 number)
01/21/2005 until 10/09/2007 --------- 92809896930(I-94 number)
10/10/2007 until 06/02/2008 --------- 34786387997(I-94 number)

In I-765 form for
question 10(Alien Registration number or I-94 number(if any)) what do i have to enter?

This evening, news media outlets are reporting that Solicitor General Elena Kagan will be the nominee to replace Justice John Paul Stevens on the US Supreme Court. Kagan was asked last summer by the Supreme Court to opine on whether the high court should hear a challenge to the constitutionality of the 2007 Arizona employer immigration sanctions law. Kagan has so far not provided an answer and she'll no doubt be asked about this. She'll also likely be asked about the new Arizona law.

Hi friends

I travelled out of USA and am trying to get back into USA with AP. I am using H1B(not stamped).
THey temporarily transferred to me indian office for this duration.

I also have EAD with me(not yet started to use).Now My co. is not letting me to go back to USA
without a project.If incase i want to change my employer, how can I do it..

Will it hurt to go back without employers permission to USA and then to use EAD to get a job?
After this I plan to submit my resignation.For EAD, 180 days already crossed.

If I want to do the above,how many days I have to get a job with EAD with a new employer after I go to USA?

What are my options?

I am on H1 B visa. I want to change my last name. If any H1 B visa holder has changed his/her name in US, please let me know the procedure and probelms encountered during the process.

My second question is - I have valid H1B visa stamp on my passport, If I change my name, do I have to go out of the country to get my visa stamp again ?

Currently am on H1 with GC Sponsoring company. I have also filed my I 485 in July 07.

I have got a contract project interview with a prominent company. But I was told that I have to be on W2. I am not clear what does that mean.

Does it mean that I have to move over to EAD if I get the offer?

Can I still work with the sponsoring company and be on w2 for the contract. I am not sure what is correct way of going with the offer. Can some one help me understand this?

Hello,

I run an IT business from here in Canada and make about US$ 80K/Year. I am now thinking to move to USA and was wondering how I could use my company to benefit and help me with that.

Is it better to move the company to US or is it better to open a subsidiary in USA? Also what are the minimum requirements to be successful in the immigration visa? Do I need to declare a minimum amount to the Canadian government etc.., that will be a proof for my company etc..?

I run the company myself with my common-law-partner. We do everything, including sending bills, invoices etc..

Did anyone notice that Compete America seem to have changed its website recently? I visited their website after sometime and it seems that they changed it recently.

C. List your present and past membership in or affilation with every organization , association, fund....

I am currently a member of the below listed service oriented/not for profit organizations.

Do I need to tell about them?
