The National Foundation for American Policy has issued an important report analyzing the interplay between of trade laws and S.887 and S.2804, bills introduced by Senators Grassley and Sanders, which would impose an array of new restrictions on skilled workers. H1-B quota got filled up on May 26, 2006. You have to wait till April 1, 2007 to apply for H1-B, unless the company falls in the exempt category (non-profit, university...). If the SKIL bill is passed in the lame duck session it can change things as well.
In your best interest is to contact an attorney that can help you with the details.

Hi,

Currently i am working as full time employee on H1B, receiving W2. I have EAD valid until Oct 2010.

Can i use EAD to work part time and receive 1099 as income statement? If i use EAD / 1099 will this cause an issue for I-485 approval (AOS is pending) ?

She come her on H4, because her husband is here. She can come here again on H4, if H1 is denied. Why she is staying in India, if her family is here ?
What is the reason for denial ?.
If it is because of education, chances are less to get approval again.
Otherwise try another company.

For those of you that have NOT contributed and RETROGRESSION is affecting your lives.

Wake up and do something for yourselves!!

What is the matter with you folks??
Why does it have to be pointed out time and again, that by contributing, not only are you strengthening IVs hands but this will eventually allow you to achieve your goals and improve your lives.

Is this a big task?
At least stay united for ONE cause in your lives.
All that is needed is a small contribution, nobody is asking for blood or your first born!!

I'm Cuban and I met my wife while on a trip to the island. I brought her over to the states on a K1 visa. Unfortunately things did not work out between us. Now she is going back to the island for a while and plans to come back. She still has not been here the 1 year and 9 months she's required to stay married to me in order to fulfill all of the K1 visa requirements.

My question is; if she leaves the states and we have divorced, will she be able to re-enter the states?

Let me know if more info is needed.

Any advice/suggestion/counseling will be most appreciated.

Very recently our company advertised for a position, this was for one of my co workers from China, company received over 200 resumes, I heard that the new rule is to reply to all the resumes and tell them why they dont qualify etc..

Our new company policy: No more employment based green cards for another 3 years :D
