I guess this has become typical of every lawmaker to say 'We need to reform ______', without initiating any action. So far health care, immigration, financial industry have gone in that blank, more to come..

Silvergate did academic evaluation for me for my I-140 and they did an excellent job on my case which i needed rushed and they gave me efficient next day processing. I had contacted other evaluation services first who would take longer and were more expensive. I definitely recommend them.

My law school roommate and long time friend Henry Olsen is the vice president of the conservative think tank the American Enterprise Institute. I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.
Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.
Please suggest.

According to a FAQ on Murthy.com about the Yates memo, it is possible to switch jobs (using AC21) if 140 and 485 have both have been pending 180 days. Murthy doesn't advise this under normal circustances because if an RFE is received on the 140, then it is problematic if you've left the company.

Friends,
With only 3 weeks left in Sep 2008 (keeping in mind that my PD is current since Aug-01), I have decided to contact DHS Ombudsman and Congressman for help.
But I dont know how to start.
I read the posting from googler.

Does any one know?
Also, how do I go about contacting Congressman? I can look up their address but dont know how to make a first move? should I write to him directly or should I call his office and explain over phone?

My employer filed for I-140 and I-485 last year July. My I-140 got approved with a labor converted from RIR.
I want to know the priority date in the approved I-140. But the employer is not giving me copy of I-140. I called USCIS and they say they cannot give the information to be.
How do i get my priority date now?
I have I-140 and I-485 receipt numbers.
Can you find it thru I-485 receipt number?

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Guys, applied recently for EAD and its pending and 180 days has not passed. I am planning to open a part time business. Does anyone know if its ok to start a part time business before the EAD gets approved ? Any insights will be appreciated.

If you draw salary as an employee of the business, it is a problem. Consult an immigration attorney. You cannot take up any work other than what is approved as part of your H1-B.

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

I know many friends of mine, who has done B.E and MS from diferent background (like Mechanical, Electronics etc) and were still able to get the LC approved from a software company since they were working there. There should not be any issue with it.

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?
