Hi All,
I just called USCIS using the POJ method to check on my I485 status which is current for June (EB2 India PD is 3/20/04).
IO said a visa needs to be ordered for the file and it will be done in the next quarter i.e, July 08.She also said the file will not be assigned to the IO unless the visa is ordered??
Does this mean that all the visas for EB2 have been used for this quarter? Also, not sure why the file wont be worked on until the visa is ordered...which contradicts the pre-adjudication theory.

do you get a FP notice only if you file AP and EAD along with your 485 ?
FP is for 485. so even if you dont apply for AP or EAD, u should still get FP notice.

I am trying to apply my AP (I-131) renewal. My current AP will expire on Oct 17 2009.
I had few questions about the form. Can someone please help me with the answers of my questions?
Part 1
Q#3. Class of Admission: I used my AP to enter the country on Sep 7th 2009. I am currently working on EAD. What should I enter for this field?
Part 3
Q1. Date of Intended Departure: I do not have any trip planned right now. What should I enter for this question.
Q2. Expected Length of Trip: What should I enter for this question?
On Part 7 it says that
"On a separate sheet of paper explain how you qualify for an advance parole document, and what circumstances warrant issuance of advance parole."

I filed I-485 in Jan 2007 under EB-1 in Nebraska Service Center. Got finger-print, EAD, AP in April. No other status update after that. Online case registration shows LUD for April.
- Online processing dates show "Dec 19, 2006" for EB-1 I-485. Any idea when I should expect any updates ? What will be the next steps involved ?
- Any way to find out whether my application is sent to name-check ?
- Anyone else in the same boat ? If you filed around Jan/Feb 2007, please do reply back to this thread, or my email vinay.shah73@gmail.com

I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:
Part E. Attorney of Agent Information
16. Law firm/Business FEIN:
This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.
If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.

I have been in H-1B status for 4+ years. This year, I started attending full time college and had applied for transfer of status from H-1B to F-1. However, my application is still pending with USCIS. Since I need to travel home urgently, I was wondering what steps should I take before leaving so that my status is not affected. Because if I travel abroad, I will be applying for new F-1 at a US consulate, do I need to cancel my application with USCIS here before leaving? Are there any consequences of keeping my application pending here.

Right now I am on my 5th year of H1B with company A. If I file for labor with Company B and got approved in a year with out holding a H1 in Company B . can i get 7th year h1 extension with company B as they already have my labor approved? any inputs will be a great help. thanks in advance.

My wife currently is on an H1-B visa and she also has EAD/AP based on my I-485 filing. Due to personal reasons she plans to quit her job soon (next 2-3 weeks or so). What will be her status? Should we be filing COS to H-4? Can we get a RFE for proof of her employment when I-485 is processed?

I am on H1 (primary), currently working for this company for past 6-7 years. Applied for I-485, AP, EAD on 2nd July along with my husband's petition, who came to US on H4. Changed to F1 for past 5 years. He just got his EAD card and in next 6 months time, he will be accepting position with my same company upon graduation.
My question is what shd we do now, since he is on F1 on student records, but has a EAD approved.
Possibilities :-
1) Shd he call his student dept and get records changed from F1 to EAD holder?
2) Shd he continue as F1 and not worry about EAD for now?
3) Shd he accept the pjob offer on EAD and move on from there?
4) Can I continue to be on H1 and not use up EAD for now?
Pls. advise me our further course of action, which is legally correct.

My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.
Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

My VISA stamped expired long back. I have valid H1 extension and my I94 is valid till October 30 2007. I am in the process of 8 th year H1 extension. Do I need to revalidate my visa to apply I � 485?

You can initiate the process for both of you individually. Means u can apply Labor, I-140 individually. After that while applying I-485 its advaisable to move with the lawyer suggestion. So till I-140 you both can apply individually.

I already have my 485 pending at NSC. My state comes under TSC jurisdiction.
Where should i file for my EAD, if I don't file concurrently with 485? at NSC where my 485 pending or at TSC?

Hi,
I received RFE on my 485 for I94 copy. My situation is below
I travelled to Tijuana, Mexico from San Diego by road to request
for new I94 at the US Port of Entry at San Ysidro, Tijuana as my old I94
was issued only until PP expiry date but since i already had a valid I94 on H1B notice, The officer didn't issue a new white I94 card even though i requested for one. Also, The officer took my earlier old white I94 card, so i don't have one with me now though i have a copy
of it. Also USCIS is asking for a detailed explanation as to why new I94 was not issued at POE. please advise on how to respond to this RFE
