My AP was approved on 06/25/07 but there is an LUD on it on 08/12/07. Can somebody tell me what it can be? Thanks

I am in a unique situation. I have filed for my H1B through company A and pretty recently got a 3 year extension too. I also have an approved Labor and I-140 through them. This May the company had an asset only aquisition and is now operating under a new name and Employee ID. Since we are all open to file our I-485 I contacted my immigration lawyer and explained the company reorganization. At first the lawyer was claiming that we should file an Amended I-140 due to the reorg. My company lawyer informed my Immigration Lawyer that the new company has not taken over the liabilities of the old company, it only took over the assets. Now my immigration lawyer claims that I will have to transfer my H1B to the new company and move forward with my original I-485 application and then port after 180 days. I wanted to get a second opinion from someone on this board.

Hi,
My spouse was on H1, the applied for H4 which was approved but he start date was incorrect, so an I102 was applied to get the I-94 corrected , we got the dates incorrect again so the lawyer applied for correct of dates again (October 2010). This whole thing has been going on for an year now.
In the mean time, we had a family emergency and my wife had to go to India , She went on a valid AdvanceParole. ( We have a pending 485 , so got an AP also)
Today we received a mail from USCIS, asking her to attend an interview regarding this I-94 replacement.
. She is not in US
. She submitted all the I94 cards she had at the Aiport
1. Will she have any problem coming back. She was always on Status. NO issues there
2. Is there any way to postpone the interview ?
3. Does it affect my I-485
4. What is the best course of action

Can i travel on my H1B and Advance parole (EAD) and maintain the same H1B when i come back to the US? I've heard rumors that I will be forced to use the EAD on arriving at the airport. Hence I will lose my H1B (They have been serving as backups to each other)
Here are some additional details:
- Currently working for a company as an employee on my H1B
- H1b doesn't have valid stamping (should i go that route and get that??)
- My 485 Pending. Priority date is Aug 2005 on EB3
- Indian Citizen but born in Africa (EB3 is Rest of the World)
- Have had my EAD for the past two years (havent used it).
- i switched over companies last year and ported the greencard process - AC21
- I have an expired Advance Parole i filed over an 1 1/2 years ago (never used it) and was planning on re-applying for it
- I've lived in the US for the past 15 years and have at no point been illegal.
- Planning to travel to Europe in June.

Hi,
I am looking for some advice regarding a seemingly peculiar situation.
my company has filed for my H1B this year alongwith h4 for my wife. My wife is on the verge of getting herself a job. My question is ...since this year's cap hasn't been reached....can she get a h1 visa and if yes how does her already having an application for h4 affect her h1b filing process.

it is safe to go with EB3 route. You can file another one in EB2 latter and port the date.

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

I see the following address in the I-485 form. But it is a PO Box address.

I think Fedex will not accept PO Box address. Is it true ? So, what is the correct address for sending I-485 and I-765 using Fedex Overnight ?

As of April 15, 2010, approximately 13,600 H-1B cap (http://www.h1b.biz/lawyer-attorney-1137085.html)-subject petitions had been filed. USCIS has approved 5,800 H-1B petitions for aliens with advanced degrees.
Many immigration lawyers are seeing a sharp decline in the interest in the H1B visa this year by potential employers and workers. Some are saying that the downturn in H1B applications this year could be as much as 60%. As a result of this decline, there are predictions that the quota will not be reached within the first few months of this year. Rather, many suspect that the bachelor's quota won't be reached until the middle of July, and that the master's quota won't be reached until later this June.
We shall see how the number will play out in the next few months.
