Guys:
Need your input in a scenario of a friend of mine. My friend's wife is on H1 for the past 4 months and wants to transfer to an H4 visa under her husband. The wife's employer has not paid her any salary nor has he got her any project for the past 4-5 months, hence they are forced to make this decision. The h1 my friend's wife is only H1 approval papers and it is not stamped on her passport. The wife's employer is not willing to give her any papers of release or letter of leave without pay from her employment.
She needs to desperatly change her status to H4.....Suggestions needed??
Question=> Can my friend's wife go to India and apply for a H4 visa directly from the US Consulate in India? Without any papers related to the H1 visa??

Hi,
I have been married to a US Citizen for more than 6 years and my green card was issued 5years ago. My green card was issued thru marriage. On the N-400 application form for citizenship what should I use as my eligibility? marriage or being a lawful permanent resident for at least 5 years? Thanks :)

This is my situation:
I am in my 8th year of H1B extension (2 one year extensions after 6 years)
I had my LC I140 approved, but due to retrogression I cannot continue with the adjustment of status.
This is my question:
If I move to a new position that would require me to file new LC (PERM), am I still subjected to the 365 days rule?
I am confused because my employer filed the LC 365 days prior to my H1B expire on the 6th year in order to get the extension. Now, since I can only have one year extension and I have less than 1 year left on my H1B visa, can the new LC still be filed? Will this jeopardize future H1B extension?
Am I missing something here? Is there another strategy?
Based on other discussion, it seemed that I am eligible for 3 years extension. But there are still 200 days left on my H1B visa. I suppose 3 years extension cannot be filed until near expiration date.

The latest processing times have been updated but not the Processing Trend Dashboard.
I believed after the USCIS Site re-design they were going to be prompt with these updates.
What is Strange in that is, the September data is showing as Zero ?!!

My last H1 transfer gave me a 3yr H1 approval. But in reality, this will make it 1 year more than the 6 years allowed. My Perm and 140 are approved before the 6th year ended and my company filed a H1B amendment request just a day before 6th year ended. It is still pending. Now, my wife is in india and she has to get back here for filing 485 in july. Can I use my existing H1 to apply for visa in this situation?

Dear Gurus,
I have applied for my I-485 in July 2007. A false DV case was filed against me by my ex-wife in January 2008 which was dismissed with prejudice in the court. I have all certified copies from court.
Now I got I-485 first interview letter from USCIS which is scheduled in Detroit.
Can I attend by myself or do I need to attend with a lawyer?
Could you guys advice me..

Another thing I would like to mention. My I-140 got approved couple months back but applied I-485 during July 2007, so it's more then 180 days for I-485 not for I-140.
Any suggestion.

Looks pretty good; the focus is on the building as I assume you would want it, due to the relative lightness of the various parts of the image. I would suggest, however, cropping some from one side or the other, to cause the composition to be less centered.
