May of you may be familiar with Professor Vivek Wadhwa from his columns in BusinessWeek and his major papers published on skilled worker immigration. I got to meet Professor Wadhwa when we both spoke at an ImmigrationWorksUSA conference a few months back. He gave a very informative presentation using the slides I'm attaching. Hey,
I have a 290B pending at Texas which was submitted on 20 Nov 2007. I had a LUD on 27 Nov. Nothing happened after. Based on others experience (in NSC) it is taking about 4 months for something to happen. No clue about TSC. Just sit tight and have a backup plan. Good luck.

Did you move to a state, which comes under Nebraska Service Center? Hence your 485 application would have got moved to NSC.

what an ignorant ass. doesnt he realize that IV core is made up of us. Need advice on how to reopen a bia appeal. We have vacated an aggravated felony Sept 25 that precluded any relief. Ninth circuit review pending and im seeking an extension on the opening brief until I find out bia status. The question I have is if i should just use IAC as an argument or just try to reopen based on a material change? I dont want to open a "can or worms" but the attorney throughout the 5 year court proceedure never advise to vacate or any post conviction remedies. Bia appeal decision Apr 29/09 is past the ninty days.

hi,
As far as I know you do not need to get a new visa stamping. At least, it was like that when I was on F-1. What you need to re-enter is to have I-20 from new school. Check with the school's international students adviser.

Hello
I came to the U.S when i was 12 from germany on a vwp and have stayed here ever since i'm 21 years old now married to a U.S citizen, I have all the papers filled out ready to send to the USCIS for AOS thru marriage to a us citizen but our attorney has warned us that there has been recent denials in these types of cases Im very terrified and clueless i dont know if i should proceed and go for it or just wait and see if anything changes.
Please let me know if you or someone you know has gone thru this.

I filed I-131 for AP renewal around 10th August and received a Biometrics appointment notice for I-485 yesterday. Is there Fingerprinting required for AP? If yes, why is the Case Type on the notice I-485? Or is the FP notice for I-485 and it is just a coincidence that I have filed for AP renewal. My PD will be current next month...

My brother is US Citizen and my parents visited US, my brother want to apply green card for my parents. What all the documents from India are needed from my parents to apply for GC?
1.What forms/applications do we have to apply?
2.What is the first step should we have to take?
3.Do we need to apply form I130 and along with that can we apply I485?
4.What all documents should my brother submit along with the forms/applications?

Hi Guys,
I am masters student from USA. Last june i graduated masters and started my OPT. My OPT ends 2009 feb. In this April 2008, i have applied for H1 and just few weeks back i came to know that my H1b got approved. Its validity date will be from October 2008. I want to go to visa stamping in canada or mexico in july or august or september ie before october(h1b valid date) only. Is this possible.
Will i get any problems while returning back to USA from canada as my h1 validity date is from october. Is it possible that even if i get visa stamped, can i go to india in september like that as we are having some family function over there and planning in advance.It would be great if you can clarify my doubts.

I have an approved labor and I-140 (EB2) with a PD of Aug 03, since USCIS guideline says that the demand for EB2 India seems to exceed the supply of GCs, I am not sure how much longer it will take for my PD to be current.
My company has a approved labor (EB2) with PD of 2002 (with job requirements matching my qualifications). I have the following questions:
1. Can I apply for premium processing for the I-140 stage with the substituted labor?
2. If not, does it take longer to process I-140 with substituted labor than the normal case?
3. if I can get the labor with 2002 PD, can my company give my labor to someone else (especially since my I-140 is already approved with that labor)

Can someone give me any suggestions?
I have filed for my AOS, last week.. I am assuming that i will get my EAD, AP in next 3-4 months......
a.) Once we get our EAD's can we go to India for a period of 6 months...even without receiving our physical GC? and yet return to US??
b.) After filing for AOS, can we leave US for a long period (6 months)..so in that case will we still get our EAD/AP/GC's???????
any answers?
